Úvodné ustanovenia
1. These General Terms and Conditions (hereinafter referred to as the "GTC") regulate the rights and obligations between ALACRES s.r.o., with its registered office at Piešťanská 86, 922 07 Veľké Kostoľany, Company ID: 48 247 413, Tax ID: 2120107594 (hereinafter referred to as the "Operator"), which operates Penzión Vysielač, Nový Vysielač Street, 922 07 Veľké Kostoľany, Slovakia (hereinafter referred to as the "Guesthouse"), and its customers (hereinafter referred to as the "Guest").
Accommodation Reservation
1. A reservation can be made:
a. electronically (by e‑mail or via the online form)
b. by phone
c. in person
2. A reservation is considered binding only after it has been confirmed in writing by the Guesthouse. At this moment, a lodging agreement is concluded between the parties.
3. The lodging agreement gives the Guest the right to be provided with temporary accommodation by the Operator for the agreed period or for the duration arising from the purpose of the stay at the Guesthouse.
4. The Guest is obliged to pay the Operator for accommodation and related services the price within the deadlines specified in these GTC.
Deposit and Payment Terms
1. After the reservation is confirmed, the Guest is required to pay a non-refundable deposit of 50% of the total stay price.
2. The amount must be paid no later than 3 working days from the confirmation of the reservation; otherwise, the Operator reserves the right to withdraw from the lodging agreement and cancel the reservation.
3. The remaining balance for the stay is payable upon the Guest’s arrival. Payment can be made by bank transfer, card, or cash. If the remaining balance is not paid on the day of the Guest’s arrival, the Operator reserves the right to withdraw from the lodging agreement and cancel the reservation.
4. The Guest is obliged to pay the Operator, no later than on the last day of the stay, the price for all services provided in connection with the stay at the Guesthouse, based on the presented invoice.
Cancellation Policy
1. The 50% deposit is non-refundable.
2. In case of reservation cancellation in accordance with these GTC and/or applicable legal regulations, the paid deposit is non-refundable and cannot be transferred to another date, unless otherwise agreed.
3. The Operator may withdraw from the lodging agreement before the end of the agreed period if the Guest, despite a warning, seriously violates good conduct in the Guesthouse or otherwise seriously breaches their obligations under the agreement and/or the house rules.
4. In the event of early termination of the stay in accordance with these GTC and/or applicable legal regulations, there is no entitlement to a refund for unused days.
Arrival and Departure
1. Check-in: from 2:00 PM to 6:00 PM, unless otherwise agreed.
2. Upon arrival, the Guest is required to present a national ID card, passport, or another valid identity document to the Guesthouse staff.
3. A reserved room that the Guest has not occupied by 6:00 PM on the day of arrival, without an agreed later check-in, may be cancelled by the Guesthouse (withdrawal from the lodging agreement).
4. Check-out: by 10:00 AM.
Rights and Obligations of Guests
1. The Guest undertakes to:
a. comply with the Guesthouse’s house rules and properly use the premises allocated for accommodation and the services related to the stay,
b. behave considerately towards other guests and observe good conduct,
c. not cause any damage to the Guesthouse’s facilities,
d. not make any significant changes in the premises allocated for accommodation without the Operator’s consent,
e. in case of causing damage, reimburse the full amount upon the Operator’s request, which will include documentation of the damage and its extent (e.g., photo/video evidence).
2. The Guest has the right to use the premises allocated for their accommodation, as well as to access the Guesthouse’s common areas and use the services provided in connection with the stay.
3. The Guesthouse is obliged to hand over to the Guest the premises allocated for accommodation in a condition suitable for proper use and to ensure the uninterrupted exercise of the Guest’s rights related to the stay.
4. The Operator is not responsible for:
a. the Guest’s personal belongings left unattended,
b. any damage incurred by the Guest outside the Guesthouse,
c. damage caused by force majeure (power outage, natural events, etc.).
5. The Operator is not responsible for items forgotten or lost by the Guest. Forgotten items at the Guesthouse are recorded and stored for a period of 3 months. After this period, the Guesthouse hands over the forgotten items to the local lost and found department. The Guesthouse will only send forgotten items to the Guest if an arrangement for this procedure has been made.
Personal Data Protection
1. The Operator processes Guests’ personal data in accordance with the applicable laws of the Slovak Republic and the EU (in particular, the GDPR), solely for the purpose of providing accommodation services. More information on personal data protection can be found on the website www.vysielaccc.sk.
Final Provisions
1. These GTC enter into force on 1st September 2025.
2. The Operator reserves the right to amend these GTC at any time, with the current version always available on the official website of the Guesthouse.
3. By making a reservation, the Guest confirms that they have read these GTC and fully agree with them. These GTC form an integral part of the lodging agreement between the Operator and the Guest.
4. Rights and obligations of the parties not specifically regulated in these GTC are governed by the provisions of generally binding legal regulations applicable in the Slovak Republic, in particular the Civil Code.
5. If the relationship established by the lodging agreement contains an international (foreign) element, the contractual parties agree that their relationship shall be governed by Slovak law, and the general courts of the Slovak Republic shall have jurisdiction to resolve disputes. This does not affect the consumer’s rights arising from generally binding legal regulations.
6. If any provision of these GTC is invalid or ineffective, or becomes so, it shall be replaced by a new provision whose meaning most closely reflects that of the invalid provision. The invalidity or ineffectiveness of one provision shall not affect the validity of the remaining provisions of these GTC.
